VA a lot of people were against those acts, mostly democrats, now they support them. I lose no sleep over POWs or people of foreign origin in battle being taken prisoner and held and interrogated. I have big problems with what took place in Boston for those innocent of any crime.

I also have problems with outright lies by Boston police and the FBI which are starting to filter out.

On Oct. 17, 2006, President Bush signed a law suspending the right of habeas corpus to persons "determined by the United States" to be an "enemy combatant" in the Global War on Terror. "

The Military Commissions Act of 2006, a bill which suspended habeas corpus for any ***alien*** determined to be an "unlawful enemy combatant engaged in hostilities or having supported hostilities against the United States. The Supreme Court ruled in Boumediene v. Bush that the MCA amounts to an unconstitutional encroachment on habeas corpus rights, and established jurisdiction for federal courts to hear petitions for habeas corpus from Guantanamo detainees tried under the Act.

Lets put this matter to rest. The precedent for this case has already been set by German spy's and saboteurs in WWII.

They were put on trial, they were not armed soldiers, they were not armed soldiers in uniform, they were special forces... technically illegal combatants which at the time could be executed on the spot.

Look to the airborne infantry of WWII, they were rarely taken prisoner and often took few prisoners.

Unfortunately rights are tweaked for not just wars, but mostly based on emotion. We should not suspend civil rights for any reason especially emotion.

Yes, we did. It was terrible, but suspending due process rights wouldn't have prevented it.

Not to minimize the atrocity in Boston, but sending poison through the mail to the President and a Senator is (to my mind) more of an attack on the state than killing and injuring people at a marathon race. Why not declare the suspect a combatant and put him on the fast boat to GITMO? No lawyer, no right to confront charges and witnesses against him, no due process.
