Normally I am a BOR guy, I have a pocket constitution I carry around with me in my left breast pocket. But sometimes.... and it has nothing to do with where the guy was born, I think you just cannot...fuck, it hard to even say.

In at least 2 cases in recent memory I was stopped in my tracks in disbelief by news headlines. Both times was because that sick fucktard who shot up those folks in the movie theater was taken alive, the second was when one of the Boston bombers was taken alive. In my humble opinion, that should not have happened. I just cannot give a rat's ass as to why they did what ever they did. You put rabid dogs down...period.

If I recall, Heller specifically rejected the "rational relation" test (sometimes called the "reasonableness" test) as a standard of review.

Beyond that, I'm not going to go further into a legal debate with someone who is manifestly unable to keep up. Carry on.

"Passing a gun law that is subject to judicial review is very different than advocating that this kid be shipped off somewhere as an enemy combatant, specifically in an attempt to avoid judicial involvement. "

Sure, One right is more important than another...even though it's the 2nd right specifically mentioned.

If I recall, the word 'reasonable' was thrown around quite a bit in Heller.

Ever hear of the "strict scrutiny" test?

When some statute burdens a fundamental (constitutional) right, courts don't use a "reasonableness" standard of review; they scrutinize the law much more strictly.

Any gun restriction can be challenged in the courts; people who remember high school civics have heard of checks and balances, separation of powers, etc.

Passing a gun law that is subject to judicial review is very different than advocating that this kid be shipped off somewhere as an enemy combatant, specifically in an attempt to avoid judicial involvement.

Well I could have given you the Spin-a-hoy, and kept pointing out that you don't care what Bloomberg thinks...you don't care that we have to change our interpretation of the Constitution.
