On Oct. 17, 2006, President Bush signed a law suspending the right of habeas corpus to persons "determined by the United States" to be an "enemy combatant" in the Global War on Terror.

In the early days of the U.S. Civil War President Abraham Lincoln suspended writs of habeas corpus.

Yes, we did. It was terrible, but suspending due process rights wouldn't have prevented it.

Not to minimize the atrocity in Boston, but sending poison through the mail to the President and a Senator is (to my mind) more of an attack on the state than killing and injuring people at a marathon race. Why not declare the suspect a combatant and put him on the fast boat to GITMO? No lawyer, no right to confront charges and witnesses against him, no due process.
