The Constitution of Virginia protects the right of the people to keep and bear arms from government infringement.

Virginia: That a well regulated militia, composed of the body of the people, trained to arms, is the proper, natural, and safe defense of a free state, therefore, the right of the people to keep and bear arms shall not be infringed; that standing armies, in time of peace, should be avoided as dangerous to liberty; and that in all cases the military should be under strict subordination to, and governed by, the civil power. Art. I, § 13 (enacted 1776 without explicit right to keep and bear arms; "therefore, the right to keep and bear arms shall not be infringed" added in 1971).

This is not to imply that courts have totally ignored the impact of the Second Amendment in the Bill of Rights. No fewer than twenty-one decisions by the courts of our states have recognized an individual right to keep and bear arms, and a majority of these have not only recognized the right but invalidated laws or regulations which abridged it. Yet in all too many instances, courts or commentators have sought, for reasons only tangentially related to constitutional history, to construe this right out of existence. They argue that the Second Amendment's words "right of the people" mean "a right of the state" — apparently overlooking the impact of those same words when used in the First and Fourth Amendments. The "right of the people" to assemble or to be free from unreasonable searches and seizures is not contested as an individual guarantee. Still they ignore consistency and claim that the right to "bear arms" relates only to military uses. This not only violates a consistent constitutional reading of "right of the people" but also ignores that the second amendment protects a right to "keep" arms. These commentators contend instead that the amendment's preamble regarding the necessity of a "well regulated militia... to a free state" means that the right to keep and bear arms applies only to a National Guard. Such a reading fails to note that the Framers used the term "militia" to relate to every citizen capable of bearing arms, and that Congress has established the present National Guard under its power to raise armies, expressly stating that it was not doing so under its power to organize and arm the militia.

And the State has the right to regulate them. Read Scalia's opinion. He nearly screams that REGULATION is not only the right of the State, but the responsibility.

Oh, he said the same thing in Citizens United....Read ALL the opinions from SCOTUS on this. Essentially the state can NOT remove access to ALL forearms, though it has a RESPONSIBILITY to regulate which ones.

Understand that just because the NRA and other various lobbys has been able to get their pet congresscritters to use various borderline tactics to block funding, etc for ENFORCING the laws we already have, it doesn't mean that those policies ('decisions') become law. They don't.

The ONLY argument in all of this is how much of this control pie the FEDERAL government has.

Ghost SCOTUS has ruled that it is the right of the people to own firearms.

District of Columbia v. Heller, 554 U.S. 570 the Court ruled that the Second Amendment protects an individual's right to possess a firearm, unconnected to service in a militia.

The Amendment’s prefatory clause announces a purpose, but does not limit or expand the scope of the second part, the operative clause. The operative clause’s text and history demonstrate that it connotes an individual right to keep and bear arms

The prefatory clause comports with the Court’s interpretation of the operative clause. The “militia” comprised all males physically capable of acting in concert for the common defense. The Antifederalists feared that the Federal Government would disarm the people in order to disable this citizens’ militia, enabling a politicized standing army or a select militia to rule. The response was to deny Congress power to abridge the ancient right of individuals to keep and bear arms, so that the ideal of a citizens’ militia would be preserved.

Actually, the way to know if someone knows what they are talking about in politics, is to know what's going on with politics. You don't do this by google searching and posting partisan comments on a third rate sex site. You do it by getting involved, meeting your representatives (something I was actually mocked for here by a few of the 'super rethuglikans', whose very conception of politics and political races were shown to be dismally lacking by the last election and who they all thought was going to 'win by a landslide') and knocking on doors.

It's WHY Obama won. It's WHY the Senate stayed Dem. It's WHY 2014 will be the cycle that loses the house for repubs as well.

All you silly righties just keep screaming at each other in that bubble you have going. The rest of us, the sane part, will just go on about our business of fixing the abysmal mess you left in 2008, paying the debts you racked up, fixing our economy and repairing our image with the rest of the world.

And voting is not a right, so it certainly feasible to have competency tests before a person is allowed to vote. I agree with you Perf.

What about "well regulated" is so hard for righties to assimilate? Even your saintly righties on SCOTUS completely agree that ALL forms of local government have the right AND OBLIGATION to regulate these same arms. Even the Federal government has turf in this when it crosses state borders.

Your 'right' to bear arms falls withing THAT framework. It's why you can't own a machine gun (fully automatic) weapon in ANY state without rigorous investigation and licensing.

"I think that owning a gun comes with an inherently strong responsibility and that before purchasing a gun, a person needs to demonstrate knowledge of gun law, gun safety, proficiency and prove that you aren't bat shit crazy. Basically, I just want to make sure that the people who are buying guns are competent enough to own them. "
