I'm very entertained by the fact that fj does not understand the difference between 'not guilty' and 'innocent', despite having it explained to him... very funny. "Judge Fj" Now there's a show everyone would tune in to see what the train-wreck of a JUDGE would do, not the lame ass 'contestants'....

Loving the fact that he has to creep around like a leper to read my posts. You should do the same FJ . I never understood the sleazoids that insist on forcing themselves on you even though you've blocked them, indicating no desire of any contact with their disgusting behavior ;).

User Details are only visible to members.	Correct sweet, personally I would like civil laws to be tighter, shit like the McDonald's coffee case were just stupid. Not all go that way though, it is still up to the plaintiff to prove that preponderance. Many cases the person being sued never has to step on the stand, and still win. The OJ case was bungled badly by both the prosecutors and the police, and it didn't help to have the streets crowded outside the courthouse. What I feel emotionally has nothing to do with the verdict. Add to that there are innocent people in prison who are found guilty. But by law until the verdict is overturned or erased or pardoned the person is still guilty by law. The system is not perfect, but it is clear, and concise about the rights of the accused.

User Details are only visible to members.	Civil courts are not the same as criminal courts. That is why they call them civil court, and not criminal court. In civil court you only have a preponderance of the evidence to make your story the most believable. Now remember a person can be found not guilty because someone sneezed at the crime scene'or certaion edidence was disallowed ect. This same person would not have the same advanage in civil court.

If the criminal court found OJ guilty, the plaintiff most likely would have been allowed to produce the verdict as evidence in the civil case. On the other hand, OJ probably probably was not allowed to put into defense the fact that he got a "not guilty" verdict in the criminal case. The "presumption of innocence" is a maxim that has meaning in many contexts. A "not guilty" verdict does trigger the defendant's double jeopardy rights. But it does not establish "innocence" as an affirmative fact in the civil case, because the fact was never established in the first case. FJ, the reason we got onto this tangent is because you made the silly suggestion that Quick Draw McZimmerman should be protected from my opinions on a swinger chat board because of his "presumption of innocence." OJ might have walked in and out of Judge Ito's court with a presumption of innocence, but he was never pronounced, declared, determined, proven or found innocent.
