Thank you too sweet. You are both exactly right, the burden of proof is on the state, and the is trying to prove they are guilty.

The defense does not have to prove innocence because that is already presumed. They only have to argue reasonable doubt. If the prosecution cannot prove it's case the defense really does not have to argue much.

I have heard both clients and defense use the words innocent in court. But the only job of the jury or judge in a bench trial is to determine if they are guilty or not. Only a idiot prosecutor would ever use the word innocent, but I imagine some may have.
