I do not believe that this will end up as any kind of a 5th amendment decision. Some may try and imply that it is and drag it that way but it will be decided under the limits of the second amendment. I am not an attorney but do stay up with the second amendment decisions. The Hiller and McDonald decisions is where we are right now. You can play the game of trying to tell us otherwise if you wish but as of right now we have a constitutional right to individually keep and bear arms. As of right now the AR-15 and similar weapons are not considered as a non protected weapon under that same second amendment or federal law. I live in the real world. Others can play make believe and believe anything they want to. If anyone thinks that our congress will pass this new AWB they are truly delusional.

It is a simple matter of numbers. If you take the dems and the non tea party members of the house it is an overwhelming majority. That's why. I can add.

I just went back to refresh myself on the Heller case. The decision mentions M-16's specifically but does not pointedly make statements about any semiautomatic weapons of any kind. Although many on the left love to try and confuse fully automatic weapons with semiautomatics they are not the same. An M-16 is not the same weapon as an AR-15. The internal parts of the lower receiver are not Interchangeable and the AR-15 does not fire as a machine gun or fully automatic weapon as the M-16 does. The decision refers to Miller while discussing weapons that may not fall under the protection of the second amendment. They must be “in common use at the time”, and not be considered "dangerous and unusual weapons" as compared to other common weapons that are also available at this time. The AR-15 is the most popular weapon being sold today and for the last several years with many millions of them in civilian hands today. So it would be impossible to claim that it is not common. The AR-15 fires at the same rate of fire, the exact same ammunition as several rifles that have never been on anyone's list of so called assault weapons. In function it compares directly to many semiautomatic rifles that also can be equipped with high volume magazines and that were not on the old AWB either. By direct comparison you can clearly see that the AR-15 is not any more dangerous than many other semiautomatic rifles that even Senator Feinstein finds to be acceptable and has specifically excluded in her present proposed legislation. These are the two standards that the Heller case talks about that may be outside of the protected firearms of the second amendment. These so called assault weapons do not violate either of these standards even according to Senator Feindtein.

Party Yes they would vote the money for trained armed professionals in schools. It our president supports it the democrats will go along with it and the repubs have already supported it. If president Obama steps up and says yes it will pass easily.

I know the fifth amendment argument against the NY better than you pal, and it is going to fail miserably. WHY is a complicated matter, but in simple terms the use of data already willingly given is NOT a 5th amendment violation, and there is present both for liquidation of contraband both at the State and federal level....the POINT is though...and what is significant, even this dumb ass hick lawyer from Upstate NY knew better than to try to challenge it based on the 2nd amendment

Clearly...you do not understand what the Heller decision means or entails, or it's relationship to Miller...Even the challenge against NYs new law is not a 2nd amendment argument, but a 5th amendment argument...Heller is the reason why

Norcalcpuple.....This is the congress that almost denied FEMA funding for hurricane relief, and wants to turn medicare into a coupon cutting program, do you HONESTLY think you are going to get a multi billion dollar allocation for school security out of them, and if in the HIGHLY unlikely event you could, do you think it is NOT going to be a battle between those who agree with YOU and actually care about kids safety, (Dems and Republicans) and those in the nincompoop faction of the GOP who are going to want to scrape the bottom of the barrel so their idiot constituents back home can finally make $9 an hour for the first time in their lives? If you think otherwise, you have NOT been paying attention

You are acting as if the opinion of one judge is hard written law. BS and you know it is. It may have indications but even that is up for interpretation. To represent it as anything but one non binding opinion is not honest. There is no law or SCOTUS decision that declares semiautomatic pistols or rifles as being not protected under the 2nd amendment of our constitution. Live with it.
