I have no problem with responsible gun ownership. I have owned guns in the past, although I do not now.

I just have a problem with people asserting constitutional rights where they don't exist.

Until the Miller decision is changed, the assertion of an individual constitutional right to own a firearm is unsettled, at best.

I see where you got that.

It is verbatim from the decision in Parker v. D.C., the case that overturned a gun law in DC.

Unfortunately, the case has yet to be decided in the Supreme Court, so it seems that Miller is still controlling.

Jack, I suggest you forgo law school. A mistake like that would probably get you an F.

That's funny, I just read the entire decision in US v. Miller and this does not appear in the text of the decision. So unless the law school at Cornell is somehow mistaken, you must be.

Again, I am not a legal scholar, and there has been plenty of discussion on this one.

There is nothing in Miller that prohibits the possession of firearms. However, the decision seems to tie that to a well-regulated militia.

And one would assume that the use of people generally means the same thing in a document. However, again, the peoples right may be tied to a well regulated militia. The two statements are not exclusive.

Unfortunately, neither you nor Destin can go two posts without calling someone a name. That is usually indicative of someone without a strong argument.

Maybe not in your case. Just a thought.
