mritimers I must state this as a not so well thought out or researched opinion. I have read and heard many opinions on this but never ingested this information from known accredited sources. I believe that the state, or it might come all the way down to the county sheriff would be the level that could legally and legitimately do this. I do not think this would be valid for the federal government because it is not a power defined by the constitution to be federal responsibility and therefore would fall to the state to do. Every state constitution is different from all others so I have no real data to call on past that point. This is a great question that deserves specific research. I would be interested in following that research but it will be enquire from state to state.

You may or may not need assault weapons, but either way you insist on your right to own them?

You've decided that if the most modern weapons of the time were not a threat to a neighborhood in 1790, then the most modern weapons of 2013 are also not a threat to a neighborhood?

I can and do determine what my needs are for survival and comfort. I make these decisions all the time, but not even I can decide what my rights are under the constitution. That was done long ago and has been affirmed and interpreted by the SCOTUS many times since then. Need does not equate with rights. Need does not determine rights. Rights do not determine needs.

I have seen the words murder and homicide used in here as if the mean the same thing. They do not interchange. Now we are talking about the words "need" and "right". The second amendment does not define my needs about arms, it defines my rights to keep and bear arms. That is exactly what this overall discussion is all about. What you think I need has no bearing at all on what are our individuals rights are as granted in the second amendment.

A point of perspective on this.

The people in the large areas of population have one point of view on things, including gun control, that seem totally irrational to those of us who live in areas of very sparse population. This does not make us paranoid. Many of these opinions are the result of the necessities of our world. You have heard the line of thought that goes along the line that a gunfight thrust upon you will be over in seconds when Law Enforcement is minutes away? Law Enforcement is an hour, or more, away from many of us. Our hope is that we never have to use deadly force to protect "me and mine", but we must stay prepared for that eventuality. There is no other option. The answers the folks from the beehive socialist cities have will never be my answers. We do not have anywhere near the law enforcement necessary to protect us and we never will here. We do not have mass transit for transportation, a community water system to deliver water water systems to our homes, a waste treatment system to take the sewer drainage away from our homes, or even close neighbors to turn to for immediate or instant support in an emergency. We have to provide all of these things for ourselves in the same manner as we provide for our own security. I have friends down the road a ways who live quite comfortably off the power grid. They produce and store their own electric power or use non electric technology that they own and/or have constructed to take care of necessities.

I heard that Adam broke over 46 laws leading up to the deaths at Sandy Hooks. We know he broke 4 counts of taking firearms into a GFSZ. 4 counts of transporting loaded weapons. 4 counts of theft. A couple hundred counts of child endangerment. Burglary, assault with a deadly weapon, 27 counts of murder.

Seems creating more laws really would have made little difference.
