User Details are only visible to members.	outdoors All weapons are a threat when in the wrong hands. it was true in the time our constitution was written and it is true today. The citizens of the mid to late 1700's felt that they needed then modern firearms to protect themselves from not only the oppressive government imposed on them by Great Briton but also to protect themselves from attacks from Native Americans and from the criminal element that also existed at that time. Many of these people lived far from the support of the government or any help from that quarter. There were murders, rapes, and theft in those times as well. There was organized crime and the trading of humans. Yes they needed their firearms as well. The did not rely on the antique arms of their time to fight with, they depended on the modern arms of their times for protection. I did not confuse the arms of then and now and will not be led into that comparison. We need modern weapons to contend with modern weapons in our time. This is what they and we were granted. It is what they fought for and included in the constitution they provided for us to live under and by.

User Details are only visible to members.	mritimers I must state this as a not so well thought out or researched opinion. I have read and heard many opinions on this but never ingested this information from known accredited sources. I believe that the state, or it might come all the way down to the county sheriff would be the level that could legally and legitimately do this. I do not think this would be valid for the federal government because it is not a power defined by the constitution to be federal responsibility and therefore would fall to the state to do. Every state constitution is different from all others so I have no real data to call on past that point. This is a great question that deserves specific research. I would be interested in following that research but it will be enquire from state to state.

You've decided that if the most modern weapons of the time were not a threat to a neighborhood in 1790, then the most modern weapons of 2013 are also not a threat to a neighborhood?

I make these decisions all the time, but not even I can decide what my rights are under the constitution. That was done long ago and has been affirmed and interpreted by the SCOTUS many times since then. Need does not equate with rights. Need does not determine rights. Rights do not determine needs.

Now we are talking about the words "need" and "right". The second amendment does not define my needs about arms, it defines my rights to keep and bear arms. That is exactly what this overall discussion is all about. What you think I need has no bearing at all on what are our individuals rights are as granted in the second amendment.
