From the OPs description, he was shoplifting. It's clear as day. It says he was stuffing packets and other items in his pockets! The samples are for you to try right there in the store, not pack up and leave with.

You can go to a buffet and eat all you want while in the restaurant, but you can't load up your pockets and jacket with food and walk out of the restaurant. It's basically the same thing.

I imagine there is also more to this story. He probably was confronted and other issues arose.

More than the cost of 16 packets of soy sauce and cookies, I'm sure.

What exactly is the crime here? Stealing? I didn't know you could steal something that's being given away. Even if there's a sign saying "1 per customer" I still don't even think that's grounds for arrest.

About the only way this warrants an arrest imo is if the manager asks a person not to take any more samples and that person refuses, at which point the manager asks the person to leave and the person resists. But at that point it's simply a trespassing violation. Still no thievery imo.

Shouldn't have been arrested. In the good old days the shopkeeper would have throw him in the street for being a dumbass.

While norm-violating, unless there was a sign saying "1 sample per patron" it's not arrest-worthy. If they're like the stores here, they're giving out free food. Most people take one and move on but we've often seen folks take a couple or come back - you'd think they were at the store for the Saturday lunch buffet :-) If the person serving it notices abuse they'll say something like "would you like to buy a whole package" or "you wouldn't mind leaving some for other folks would you"? If there's no server then we'd be skeptical of the sanitary conditions and avoid it altogether :-) But if you're giving away free food and don't want someone to take "too much" you have to let them know what the limit is before you arrest them. Violating a social norm is not illegal. Violation of a posted limit would be stealing and would then be illegal.

Free sample trays can lead to ugly business. Take 68-year-old Erwin Lingitz, of Gem Lake, Minn., who says he was roughed up at a Cub Foods when confronted over his allegedly egregious abuse of the lunch meat sample tray. A spokeswoman for the store says Lingitz violated "societal norms" regarding how much he took from the trays, and she might have a point: He was arrested with 16 packets of soy sauce, over a half-pound of summer sausage and .85 pounds of beef stick in his pockets. This, after allegedly filling produce bags with "up to 20 cookies from the 'kids' cookie club tray.'" We don't know the rules, but that does sound norm-violating.

Do you think he should have been arrested?
